Investing in real estate is always a wise decision. Normally an investor would research the property and the surrounding properties and area to ensure they are making a wise purchase. Another very important piece of the research is a Property Title Search. This search would examine property documents to ensure a clear/clean Chain of Title without a cloud. The following property title searches will assist when making an offer against the asking price or negotiating a final number.

A property that has been foreclosed is especially subject to liens, judgement and property taxes that have not been paid. Many times the purchaser of the property will inherit the liens (see your state laws) depending on the state. Any liens that are passed to the new owner will be a liability and sometimes not worth the great deal on the property.

The best choice for investors would be the Full Chain of Title Search. This search would examine the history of the property up to 50 years or to the original owner/developer whichever comes first. The abstractors at Title Hawks will examine the chain of title. A seamless chain without any breaks is desired. All recorded documents during the time frame will be reported and may be ordered if requested. Since this level of search is normally ordered during the escrow process, it is a good idea to independently order as an insight of exactly what you are investing your money into.

Current Owner Title Report

$95/per report

This search will enable the prospective investor to verify the current owner and description of the property is legitimate. Any current lien or foreclosure status recorded against the property will be produced after our abstractors perform their title search. The Current (1) Owner Title Search is a report that pertains only to the time frame that the current owner(s) of the property have held title.


The legal owners, legal description and if any recorded documents during that time will be reported. Documents such as liens that have been placed against the property during the current ownership, if fulfilled, should have a lien release recorded and will be included in our search results if on record. This report will help to ensure the transparency of the description of the property.

Limited Owner Title Report

If a longer history of the property is required as assurance, then the Limited (2) Owner Title Search is the alternative choice. This search will not only provide the recorded documentation of the time during the current ownership of the property but also the recorded documentation during the time of the prior ownership (2 ownerships total). The legal owners, legal description and if any recorded documents during that time will be reported.

If any type of lien has been placed against the property during the current or previous ownership, a lien release should have been recorded, if fulfilled and will be included in the search results. This search is one step further into the history of the property than that of the Current Owner Title Search. This search will add an extra layer of assurance and peace of mind to the current or prospective homeowner.

Full Chain of Title Report

$195/per report

If you would like to know that the property is clear of any encumbrances and has successfully transitioned from one ownership to another then the Full Chain of Title Search would be the best choice. This search will examine all of the same historical information as the Current Owner Title Search and the Limited Owner Title Searches but will also include information up to a 50 year history or to the developer whichever comes first.

When we refer to this search as “Full Chain” this means that each transaction of a property has or should have a seamless transition from one ownership to the next with the proper documents to support the transactions. Our examiners would be able to follow the chain seamlessly. If there is a break in the chain then further investigation would be required as to why the proper documentation was not recorded.
